These Terms and conditions constitute a legal agreement between you and KUKUVA.CY, specifically regarding the KUKUVA.CY sub-product (referred to as “KUKUVA.CY,” “we,” “us,” or “our” throughout these Terms). These Terms govern your use of the KUKUVA.CY website and the related services (collectively, the “KUKUVA.CY Service”).

By accessing or using the KUKUVA.CY Service, you agree to be bound by these Terms. If you do not agree, please do not use the KUKUVA.CY Service. The term “you” applies to both you as an individual and any organization or entity you represent. If you breach any part of these Terms, we reserve the right to suspend or terminate your account and restrict access to the service without prior notice.

Your Account

Your KUKUVA.CY account must be created by a human. Accounts registered by bots or other automated methods are strictly prohibited. You must also be at least 18 years of age to register or use the KUKUVA.CY Service.

During the registration process, you are required to provide a valid, permanent email address and any other information requested by KUKUVA.CY. Each individual or legal entity may only register one free account.

You are solely responsible for maintaining the security and confidentiality of your account credentials. KUKUVA.CY is not liable for any loss or damage resulting from your failure to meet this security obligation.

You agree not to use the KUKUVA.CY Service for any unlawful or unauthorized purposes. In particular, you must not:

  • Distribute viruses, malware, time bombs, trap doors, or any other harmful or disruptive code or programs;
  • Interfere with, bypass, or disable any security features or usage restrictions of the KUKUVA.CY Service;
  • Infringe upon the rights of others, including intellectual property rights, copyrights, or rights of privacy or publicity;
  • Engage in behavior that is obscene, offensive, pornographic, fraudulent, deceptive, defamatory, harassing, threatening, abusive, slanderous, hateful, or otherwise objectionable as determined solely by KUKUVA.CY;
  • Mislead others about your identity, impersonate another person, or falsely represent the origin of any communication or content.

Purchases & Payment

We accept the following forms of payment:

By making a purchase through the KUKUVA.CY Service, you agree to provide current, complete, and accurate billing and account information. You also agree to promptly update your account details—such as your email address, payment method, and card expiration date—to ensure successful transactions and communication.

Applicable sales tax will be added where required. Prices are subject to change at any time at our sole discretion. All transactions will be processed in EUR euro unless another currency is expressly agreed upon.

You agree to pay all charges at the prices in effect at the time of your purchase, including any applicable shipping fees, and authorize us to charge your selected payment method accordingly. For purchases involving recurring billing, you authorize us to charge your payment method automatically on a recurring basis without separate approval for each charge, until you cancel your subscription or notify us of changes.

We reserve the right to reject any order at our discretion. We may also limit or cancel orders per person, per household, or per order—based on factors such as account information, payment method, and billing/shipping addresses. Additionally, we reserve the right to refuse orders that we believe are placed by resellers, dealers, or distributors.

Refunds

Refunds may be offered in certain cases and are subject to our Refund Policy. Please refer to the policy for eligibility and instructions.

Violation of These Terms

We reserve the right to investigate and take legal action against any violations of these Terms and conditions to the fullest extent permitted by law. This may include involving and cooperating with law enforcement authorities in prosecuting users who violate these Terms.

While KUKUVA.CY is under no obligation to monitor your access to or use of the KUKUVA.CY Service—or to review any content made available through the Service—we reserve the right to do so at our sole discretion. We may remove or delete any data, accounts, or content that we determine, in our sole judgment, to be in violation of these Terms or otherwise objectionable.

Termination

We may suspend or terminate your account and access to the KUKUVA.CY Service at any time, with or without notice, and for any reason, including but not limited to a breach of these Terms. Termination will be at our sole discretion and may occur without prior warning or liability.

If you wish to terminate your account, you may simply discontinue using the Service.

Any provisions of these Terms that by their nature should survive termination will continue to remain in effect, including but not limited to ownership rights, warranty disclaimers, indemnity obligations, and limitations of liability.

Modifications & Interruptions

We reserve the right to modify, update, suspend, or remove any part of the KUKUVA.CY Service at any time and for any reason, without prior notice. While we strive to keep information accurate and up to date, we are not obligated to do so.

We do not guarantee that the KUKUVA.CY Service will be available at all times. You may experience interruptions due to maintenance, technical issues, or other unforeseen problems. We are not liable for any loss, damage, or inconvenience caused by your inability to access or use the Service during such times.

We make no commitment to maintain or provide support, updates, or continued availability of the Service. You acknowledge and agree that KUKUVA.CY will not be held responsible for any modifications, suspensions, or discontinuance of the Service.

Intellectual Property and Content Ownership

KUKUVA.CY does not claim ownership of any content you upload to or share through the Service. Your profile and all materials you provide remain your property. However, by setting any content to “public,” you grant permission for others to view and share that content.

While KUKUVA.CY does not pre-screen user content, we reserve the right (but not the obligation), in our sole discretion, to refuse or remove any content that is made available via the Service.

Indemnification

You agree to indemnify and hold harmless KUKUVA.CY, its affiliates, officers, agents, employees, and partners from any claims, losses, damages (actual or consequential), liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of:
(a) your use of the Service, including actions taken by third parties using your account; or
(b) your violation of these Terms.

If such a claim arises, we will make reasonable efforts to notify you using the contact information associated with your account (though our failure to notify you does not relieve your indemnification obligations).

Limitation of Liability

To the fullest extent permitted by law, KUKUVA.CY and its suppliers or licensors shall not be liable for any:
(i) indirect, incidental, or consequential damages;
(ii) costs of procuring substitute products or services;
(iii) data loss or corruption; or
(iv) total damages exceeding the amount paid by you to KUKUVA.CY in the twelve (12) months prior to the claim.

KUKUVA.CY is not liable for any delays or failures caused by circumstances beyond our reasonable control. These limitations apply even if a remedy fails of its essential purpose and to the extent not prohibited by applicable law.

General Representation and Warranty

You represent and warrant that:
(i) your use of the KUKUVA.CY Service complies with all applicable laws, this Agreement, and our Privacy Policy, including local laws regarding online conduct, acceptable content, and data export regulations; and
(ii) your use of the Service will not infringe upon or misappropriate the intellectual property rights of any third party.

Disclaimer of Warranties

The KUKUVA.CY Service is provided on an “as is” and “as available” basis. We make no representations or warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the availability, reliability, or quality of the Service or any third-party providers or services accessed through the Service. Your use of the Service is at your sole risk.

Arbitration

You agree that any disputes between you and KUKUVA.CY relating to these Terms, your use of the Service, or your relationship with KUKUVA.CY shall be resolved through final and binding individual arbitration in accordance with the provisions of the Cyprus Arbitration Law (Cap. 4), as amended. The arbitration shall be conducted by a sole arbitrator appointed in accordance with the Rules of the Cyprus Arbitration and Mediation Centre or another agreed arbitral institution, and the language of the proceedings shall be English or Greek, as agreed by the parties.

 

You waive any right to bring a claim before a court, except as otherwise provided by applicable law. As an alternative, you may bring your claim before a Cyprus court of small claims jurisdiction if the dispute qualifies under applicable court rules.

 

You agree to assert claims solely in your individual capacity and not as a claimant or class member in any purported class, collective, or representative action. This arbitration agreement shall be governed by the laws of the Republic of Cyprus, and any award rendered by the arbitrator may be enforced in any competent court in Cyprus.

Entire Agreement

These Terms of Service, along with our Privacy Policy and any additional legal notices we publish on the Service, constitute the complete agreement between you and KUKUVA.CY regarding your use of the Service.

If any part of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision under these Terms will not be considered a waiver of those rights.

Changes

We may update or modify these Terms of Service at any time. Changes will be posted on this page or communicated through other appropriate means. We will determine, at our sole discretion, what constitutes a material change.

By continuing to access or use the Service after changes become effective, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
